Please read these terms carefully before using AtlasLinq
1. Acceptance of Terms
Welcome to AtlasLinq. These Terms of Service ("Terms") govern your access to and use of the AtlasLinq mobile application and website (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you are agreeing to these Terms on behalf of that organization.
2. Description of Service
AtlasLinq provides a digital business card platform that enables users to:
- Create Digital Profiles: Design personalized digital business cards with contact information, social links, and branding
- Share Profiles: Share profiles via NFC technology, QR codes, phone-to-phone transfer, or web links
- Manage Multiple Profiles: Create and manage multiple profiles for different contexts (personal, professional, custom)
- Track Analytics: View sharing activity, profile views, engagement metrics, and networking insights
- Receive Profiles: Save contact information from others without requiring app installation
The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. User Accounts & Registration
3.1 Account Creation
To access certain features, you may need to create an account. You can:
- Use the Service as a guest with limited features
- Create an account using email/password authentication
- Sign in with Apple, Google, or other supported authentication providers
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
3.3 Account Requirements
- You must be at least 13 years old to create an account
- You must provide accurate and complete information
- You may only create one account per email address
- You may not share your account credentials with others
4. User Responsibilities
4.1 Accurate Information
You agree to provide accurate, current, and complete information in your profile. You are responsible for keeping your information up to date.
4.2 Prohibited Uses
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Impersonate any person or entity
- Share false, misleading, or deceptive information
- Transmit spam, phishing attempts, or malicious content
- Harass, threaten, or abuse other users
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to the Service
- Use the Service for illegal activities
- Collect or harvest personal information of other users without consent
4.3 Content Ownership & License
You retain all rights to the content you create and upload to your profile (text, images, links). By using the Service, you grant us a limited, worldwide, non-exclusive license to:
- Store and display your profile content
- Share your profile content when you actively share it via NFC, QR code, or link
- Cache and optimize your content for performance
This license ends when you delete your content or account.
4.4 Prohibited Content
You may not upload or share content that:
- Is illegal, obscene, pornographic, or sexually explicit
- Promotes violence, hatred, or discrimination
- Infringes on copyright, trademark, or other intellectual property rights
- Contains malware, viruses, or harmful code
- Violates privacy rights of others
5. Intellectual Property
5.1 AtlasLinq Ownership
The Service, including its software, design, features, and functionality, is owned by AtlasLinq and is protected by copyright, trademark, and other intellectual property laws.
AtlasLinq, the AtlasLinq logo, and all related marks are trademarks of AtlasLinq. You may not use these marks without our prior written permission.
5.2 User Content
You retain ownership of all content you create (profile information, images, links). You are responsible for ensuring you have the right to use any content you upload.
5.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to compensate you.
6. Service Availability & Changes
6.1 Service Availability
We strive to keep the Service available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable due to:
- Maintenance or updates
- Technical issues or outages
- Force majeure events beyond our control
6.2 Changes to the Service
We reserve the right to modify, update, or discontinue any features of the Service at any time without prior notice. We are not liable for any modifications or discontinuation of the Service.
6.3 Updates & Versions
We may release updates to the mobile app. For the best experience, we recommend keeping the app updated to the latest version.
7. Subscription & Payment Terms
7.1 Free Tier
AtlasLinq offers a free tier that includes:
- Create and manage up to 3 digital profiles
- Share via NFC, QR code, and web links
- Basic analytics and sharing history
- Local device storage
7.2 Premium Subscription
Premium features (when available) may include:
- Unlimited profiles
- Advanced analytics and insights
- Cloud backup and sync
- Custom branding options
- Priority support
Subscription pricing, billing cycles, and features will be clearly displayed in the app before purchase.
7.3 Billing & Renewal
- Billing Cycle: Subscriptions are billed monthly or annually, as selected at purchase
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Payment Methods: Payments are processed through Google Play Store, Apple App Store, or other authorized payment processors
- Currency: Prices are displayed in your local currency where available
7.4 Cancellation & Refunds
- You may cancel your subscription at any time through your app store account settings
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial subscription periods
- Refund requests for exceptional circumstances may be submitted to support@atlaslinq.com
7.5 Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days advance notice of price changes via email or in-app notification. Continued use after the price change takes effect constitutes acceptance of the new price.
8. Digital Business Card & NFC Terms
8.1 Profile Sharing
When you share your digital business card via NFC, QR code, or link:
- You are responsible for the accuracy of the information in your profile
- You control what information appears on your profile and who you share it with
- Once shared, recipients may save your information to their devices
- We cannot control how recipients use or further distribute your shared information
8.2 NFC Technology
- NFC sharing requires compatible devices with NFC capability
- We are not responsible for NFC hardware malfunctions or incompatibilities
- Physical NFC tags or cards are provided "as is" without warranty of durability
- You are responsible for the security of any physical NFC products you use
8.3 Data Accuracy
You represent and warrant that:
- All information in your profile is accurate and belongs to you
- You have the right to share any contact information, social media links, or other data in your profile
- You will not use the Service to impersonate others or create misleading profiles
9. Limitation of Liability
IMPORTANT: Please read this section carefully. It limits our liability to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We do not warrant that the Service will be error-free, secure, or uninterrupted
- We are not responsible for any content shared by users or accuracy of user profiles
- We are not liable for any loss of data, profits, or business opportunities
- Our total liability to you for any claims arising from the Service is limited to $100 USD or the amount you paid us in the last 12 months, whichever is greater
We are not liable for:
- User-generated content or interactions between users
- Loss or theft of NFC tags or devices
- Unauthorized access to your account due to weak passwords or compromised credentials
- Third-party services, websites, or content linked from the Service
- Force majeure events (natural disasters, wars, pandemics, etc.)
10. Indemnification
You agree to indemnify, defend, and hold harmless AtlasLinq, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Content you upload or share through the Service
11. Termination
11.1 Termination by You
You may stop using the Service at any time. You can delete your account through the app settings.
11.2 Termination by Us
We reserve the right to suspend or terminate your account if you:
- Violate these Terms
- Use the Service for illegal activities
- Abuse, harass, or harm other users
- Attempt to compromise the security of the Service
11.3 Effect of Termination
Upon termination:
- Your account and profile data will be deleted from our servers
- Your shared profile links may no longer be accessible
- Local data on your device will remain until you manually delete it
- Certain provisions of these Terms (liability, indemnification, disputes) will survive termination
12. Governing Law
These Terms are governed by the laws applicable to your jurisdiction as follows:
12.1 For Users in India
These Terms are governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India for any disputes arising from these Terms or the Service.
12.2 For Users Outside India
For users located outside of India (including the United States), these Terms are governed by the laws of India, except where local law mandates otherwise. Any disputes shall be resolved in the courts of Indore, Madhya Pradesh, India, unless prohibited by your local law, in which case local courts may have jurisdiction.
12.3 Consumer Rights
Nothing in these Terms shall affect any statutory rights that you are entitled to as a consumer under the applicable laws of your jurisdiction that cannot be contractually waived or limited.
13. Dispute Resolution
13.1 Informal Resolution
Before filing a formal claim, please contact us at legal@atlaslinq.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days.
13.2 Arbitration
Any disputes that cannot be resolved informally will be settled by binding arbitration as follows:
- For Users in India: Arbitration will be conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat of arbitration shall be Indore, Madhya Pradesh, India. The arbitration proceedings shall be conducted in English.
- For Users in the United States: Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA). The seat of arbitration shall be a mutually agreed location or conducted virtually.
The arbitration shall be conducted by a single arbitrator mutually agreed upon by both parties. The decision of the arbitrator shall be final and binding.
13.3 Class Action Waiver
To the maximum extent permitted by applicable law, you agree to resolve disputes with us on an individual basis and waive the right to participate in class actions, class arbitrations, or representative actions.
13.4 Exceptions
Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service. Additionally, claims that qualify for small claims court may be brought there instead of arbitration.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending an in-app notification for significant changes
Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the new Terms, you must stop using the Service.
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AtlasLinq regarding the Service.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
15.4 Assignment
You may not assign or transfer these Terms or your account to any third party without our written consent. We may assign these Terms at any time without notice.
15.5 No Partnership
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and AtlasLinq.
